Terms of Use for CloudSync
1. Introduction
These Terms of Use govern your use of the CloudSync software and services provided by Elevate Wellness Media LLC ("Company", "we", "us", "our"). By accessing or using CloudSync, you agree to be bound by these terms and all applicable laws and regulations.
No Refund Policy
By subscribing to CloudSync, you acknowledge and agree that all payments made to Elevate Wellness Media LLC are non-refundable.
Subscription Fees: CloudSync is a subscription-based software service. Subscription fees are billed in advance on a recurring monthly basis and are non-refundable, including partial months of service, upgrade/downgrade refunds, or unused time.
Cancellations: Customers may cancel their subscription at any time. However, cancellation requests must be submitted before the next billing date to avoid future charges. Cancellations made after a billing date will apply to the following billing cycle, and no refunds will be issued for the current period.
Access Provided: Upon successful payment, customers immediately receive access to the CloudSync platform and its features. Since services are delivered instantly and resources are provisioned upon payment, refunds cannot be offered once a charge has been processed.
We encourage all customers to review the features of CloudSync carefully and to take advantage of any free trial or demo period (if available) before committing to a paid subscription.
License
We grant you a non-exclusive, non-transferable, revocable license to use CloudSync for your personal and business use, subject to the limitations set forth herein.
Use Restrictions
You may not use CloudSync to:
Conduct illegal activities or promote harm or illegal acts.Infringe on the intellectual property rights of others or the Company.Transmit any viruses, malware, or other harmful computer code.
Account and Security
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
Modifications to Terms
The Company reserves the right, at its discretion, to modify or replace these Terms at any time. If the alterations constitute a material change to the Terms, the Company will notify you by posting an announcement on the software interface.
Disclaimer of Warranties
The CloudSync software is provided "as is" and "as available" without any warranties, expressed or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the software will be uninterrupted or error-free.
Limitation of Liability
The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages).
Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the software using your account.
Electronic Contracting and Signatures
Your use of the CloudSync services includes the ability to enter into agreements and/or to make transactions electronically. You acknowledge that your electronic submissions constitute your agreement and intent to be bound by and to pay for such agreements and transactions.
